A Series of Frequently Asked Questions about the Land Reform Act

Here we present a series of questions about the Act. These include questions we have been asked and hopefully, the answers will help you understand more about the workings of the Act.

1. Is there a source of a draft memo and arts for a company ltd by guarantee that would qualify under the legislation?

YES - See Advice Note 3 on Advice Page

NOTE - you must seek Scottish Ministers' approval for your draft memo and arts BEFORE submitting an application. Please therefore treat this task as a priority since the Scottish Executive continue to be rather particular about certain clauses.

2. How long is this process going to take?

This depends what stage of the process you are at. Assuming that you have a good idea of what land you wish to register, it will take you up to 3 to 4 weeks to set up the Community Company receive approval for its memorandum and Articles of Association. Concurrent with this you can begin to gather the information you need to complete the Application Form. This may take 4 weeks. If you are well organised you should be able to submit an application within 4 - 6 weeks.

3. We think the owner of the land we are interested in is about to put it on the market. What should be do?

What have you been doing? Get a competent Application submitted asap! If your application is not submitted until after the land has been put up for sale, it will be treated as a "late registration". You will then be required to meet additional, more onerous conditions and the timescale for completing a possible acquisition will be shorter.
